Tribe In North Carolina Bans Fracking

The Eastern Band of Cherokee Indians has joined a growing number of local governments opposing the state legislature’s decision to allow hydraulic fracturing, called fracking, in North Carolina. Earlier this month, tribal council passed a resolution outlawing the practice on tribal lands, a force of authority stronger than what county and municipal governments possess.

The June legislation that lifted the state’s moratorium on fracking included a clause keeping local governments from outlawing the practice in their jurisdiction, so their resolutions are an expression of opinion rather than an act of law. But the Eastern Band is a sovereign nation, so the tribal council is able to completely prevent drilling on Cherokee land.

“The State of North Carolina is without legal authority to permit hydraulic fracturing on Tribal Trust lands,” the resolution reads, later CONTINUINGimage, “The Eastern Band of Cherokee Indians will not permit or authorize any person, corporation or other legal entity to engage in hydraulic fracturing on Tribal Trust lands.”

THE COLLEGEimage student in Timmins has written letters to the Minister of Northern Development and Mines, Nishnawbe Aski Nation and Mushkegowuk Council expressing her concerns. Now she’s launching a petition, seeking signatures from other community members in affected First Nations.

“There is no consultation,” Wabano said. “Meaningful consultation is when everybody is included, the elders, all the residents in the community so they can be aware of what’s going on, because the chiefs can’t speak for me especially when it comes to my grandfather’s traditional territory or my great-grandfather’s final resting place.”

A spokesperson for Mines Minister Michael Gravelle said Ontario is currently focused on engaging the First Nations in the Matawa region, closest to the Ring of Fire.

But the email response to CBC News CONTINUEDimage, saying the province is “fully committed to a wider engagement strategy with our First Nation partners to drive smart, sustainable and collaborative development in the Ring of Fire, subject to the environmental assessment, regulatory approvals and the Crown meeting its duty to consult.”

New York City’s march was said to have a turnout of over 400,000 making this the largest climate march in history. The indigenous people took the lead of this march as those that are most affected by climate change.

Among them was the Lakota People’s Law Project’s own Madonna Thunder Hawk who marched and spoke at the AIM-West UN Press Conference on Sept. 19th. At the press conference, Thunder Hawk kept her focus on the illegal taking of Lakota children by the state of South Dakota, “The state of South Dakota is still trafficking Lakota children. The Secretary of the Interior on Wednesday decided against releasing water down the Trinity River to ensure the survival of the salmon runs expected this month.  The virtual trickle of water is low, too warm, and clogged with moss, while corporate farms in California’s Central Valley are receiving the government subsidized water.  The people of the Hoopa Valley Tribe and Yurok Tribe on the Trinity-Klamath Rivers are very worried that they will face another massive fish kill, as happened in 2002 under the same conditions.

California congressional representatives (Democrats and Republicans) are lining up to ram through federal legislation to raise Shasta Dam and guarantee low cost water to Central Valley water brokers for big profits.

The Winnemem Wintu of the McCloud River have paid once already, losing our lands, our river and our salmon. We received no compensation when the dam flooded us out, and then were told we’re not Indians any more.

A higher dam will drown more of our ceremonial sites, including the grounds of our Balas Chonas (Coming of Age ceremony), which make us who we are.

This little girl has to live with these pollutants because Chevron and Texaco do not take in consideration where they are leaving their waste and have no need to clean it all up.
