You can't tell people if they have the right to do somethnig or not. If you want to chose what is legal or not, you'll have to take Obama's job.
There are tribes, who use the warbonnet traditionally, who have stated that they do not want the warbonnet used as an accessory or prop.
And yes, you have the freedom to be racist and to promote racism, but that doesn’t mean you should.
